TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (hereinafter the “T&Cs”) govern all sales concluded between TKB Essential, a streetwear clothing brand, and any person making a purchase via the website www.tkbessential.com (hereinafter the “Site”).

By placing an order on the Site, the customer acknowledges having read, understood, and unreservedly accepted these T&Cs.

2. PURPOSE

The purpose of these T&Cs is to define the conditions under which TKB Essential sells its clothing products and streetwear accessories to its customers via the Site.

3. PRODUCTS

TKB Essential sells in particular:

  • T-shirts
  • Hoodies
  • Sweatshirts
  • Jackets
  • Streetwear sets
  • Caps and accessories

Products listed on the Site are available subject to stock availability.

TKB Essential strives to provide an accurate representation of products (photos, colours, descriptions). However, slight differences may appear depending on the customer’s screen, device, or display settings.

4. PRICES

All prices displayed on the Site are expressed in the applicable currency based on the customer’s region and include applicable taxes.

Any shipping costs are clearly indicated before the final order confirmation.

TKB Essential reserves the right to modify its prices at any time. However, products will be invoiced based on the price displayed at the time the order is confirmed.

5. DELIVERY ZONES

TKB Essential currently delivers to the following regions:

  • United States
  • Eligible European countries
  • Eligible Asian countries
  • African countries

The list of countries served may be modified at any time.

6. ORDERS

Any order placed on the Site constitutes an offer to purchase.

The customer agrees to provide accurate, complete, and up-to-date information when placing an order.

TKB Essential reserves the right to refuse or cancel any order in particular in cases of:

  • suspected fraud;
  • incomplete or incorrect information;
  • payment issues;
  • abusive behaviour or a prior dispute.

An order confirmation is sent by email after payment has been validated.

7. PAYMENT

Orders may be paid for by:

  • Credit/debit card (Visa, Mastercard, American Express, etc.)
  • PayPal
  • Apple Pay
  • Google Pay
  • Stripe

Payments are secured via third-party payment providers.

TKB Essential does not store any customer banking data.

In the event of payment being refused by the bank or payment provider, the order will be automatically cancelled.

8. DELIVERY

Orders are generally delivered within an estimated timeframe of approximately 7 business days, depending on the destination.

These timeframes are indicative and may be affected by:

  • peak demand periods;
  • logistics delays;
  • customs inspections;
  • circumstances beyond TKB Essential’s control.

TKB Essential cannot be held liable for delays attributable to carriers or exceptional events.

The customer is responsible for the accuracy of the delivery address provided.

9. RETURNS AND EXCHANGES

9.1 Return Period

The customer has 30 calendar days from receipt of the product to request a return or exchange.

9.2 Return Eligibility Conditions

To be accepted, the product must:

  • be unworn;
  • be unwashed;
  • be undamaged;
  • be returned in its original condition;
  • have the original tags attached.

The following items will not be accepted:

  • worn clothing;
  • washed clothing;
  • products damaged by the customer;
  • incomplete products.

TKB Essential reserves the right to refuse any return that does not meet these conditions.

9.3 Size Exchange

Size exchanges are permitted subject to stock availability.

The customer must submit their request within the applicable return period.

9.4 Return Costs

Return costs are allocated as follows:

Error attributable to TKB Essential

If the return is due to an error by TKB Essential (wrong item sent, confirmed defect, incorrect size shipped, defective product), the return costs will be covered by the company.

Error attributable to the customer

If the return results from a customer error (wrong size ordered, change of mind, personal preference), the return costs remain the responsibility of the customer.

10. REFUNDS

Once the product has been received and inspected, TKB Essential will notify the customer of the approval or rejection of the refund.

If the refund is approved, it will be processed via the original payment method within a reasonable timeframe, subject to applicable banking delays.

Initial shipping costs may not be refundable, except in cases of error attributable to TKB Essential.

11. PROMOTIONS AND DISCOUNT CODES

Promotional codes:

  • cannot be combined unless otherwise stated;
  • have a limited validity period;
  • may be suspended or cancelled at any time.

TKB Essential reserves the right to cancel any order resulting from the fraudulent use of a promotional code.

12. LIABILITY

TKB Essential cannot be held liable for indirect damages resulting from the use of products sold.

The company’s liability cannot be engaged in cases of:

  • misuse of the product;
  • normal wear and tear;
  • force majeure;
  • temporary interruption of the Site.

13. INTELLECTUAL PROPERTY

All elements of the Site, including in particular:

  • logo;
  • visuals;
  • photographs;
  • design;
  • graphic content;
  • texts;
  • brand identity,

remain the exclusive property of TKB Essential.

Any unauthorised reproduction, distribution, or exploitation is strictly prohibited.

14. PERSONAL DATA

Data collected is processed in accordance with the Site’s Privacy Policy.

Personal information is used exclusively for the purposes of:

  • order processing;
  • customer service;
  • improving the user experience;
  • applicable legal obligations.

15. FORCE MAJEURE

TKB Essential cannot be held liable for any delay or inability to perform resulting from an event beyond its control, including in particular:

  • pandemic;
  • war;
  • strike;

  • logistics disruption.

These T&Cs are governed by the applicable law of the country in which TKB Essential is registered.

In the event of a dispute, the parties agree to seek an amicable resolution before initiating any legal action.
